General Terms and Conditions
1. General information
Classic Car Analytics GmbH carries out market observations for classic and collector's vehicles via the brand classic-analytics and provides the data collected in this context to consumers, as well as business operators on the Internet. The following conditions apply for the use of the data and the associated services.
2. Consumer Usage
The comprehensive use of the classic-analytics data requires registration. Upon registration, the customer is required to accept the applicable Terms and Conditions and assures that all information provided by him or her is correct, complete, and truthful. In particular, he or she is required to upload recent images of the vehicle, which have not been altered using image editing programs.

The comprehensive use of the classic-analytics data requires registration. In particular, he or she is required to upload recent images of the vehicle, which have been taken by the customer and which have not been altered using image editing programs. Corporate customers are further obligated to keep their data up-to-date. The customer is responsible for maintaining the confidentiality of his or her data (login information, password). If the customer data are accessed by unauthorized third parties, classic-analytics must be immediately informed in this regard.
Users of the service packages M and L are permitted to use the classic-analytics brand name and the classic-analytics logo for all appraisals in which the market value is determined via the classic-analytics query system and in which the valuation corridor granted by classic-analytics is adhered to. If this valuation corridor is exceeded, the valuation is automatically considered unauthorized by classic-analytics, and in this case, the burden of proof and liability for the value difference is borne by the valuation partner. Appraisals without the use of this query system are permitted, but may not be carried out using the classic-analytics brand in any way (logo, name references etc.). In case of non-compliance, classic-analytics reserves the right to terminate the contractual relationship without notice. To maintain a uniform appearance, the customer is asked to insert paper-based appraisals into a classic-analytics binder.
The billing for appraisal services and advertising material orders is done monthly, on the first of each month, by email. To this end, the current invoice is deposited in the customer's online account, and the customer is informed about it via email to the email address provided in their profile. The billing for other services is done by email or postal mail. classic-analytics is permitted to cease the provision of services after payment defaults lasting more than two months.
The selected service package runs for one year. It begins when the customer is notified and is automatically extended by one year, unless a written cancellation notice is submitted three months before expiration.
The customer is required to keep his or her master data updated, particularly his or her contact information, and shall make modifications to his or her profile independently. If additional expenditures or damages are incurred due to failure to update, the customer must bear the costs.
For seminars, no processing fees will be charged in case of a cancellation up to 4 weeks before the start of the seminar, after which a reimbursement of the seminar costs is excluded.
4. Scope of services
classic-analytics provides current, neutral, and evidence-based market observations for the vehicles in question. Depending on the product, classic-analytics services further include a check of the vehicle identification number, as well as a plausibility check of the condition rating determined by the customer using the submitted vehicle photos. This entails a visual check of the vehicle's appearance to assess whether the indicated condition ranking appears plausible. classic-analytics reserves the right to reject requests without naming reasons.
The prices for the services rendered by classic-analytics can be reviewed on the classic-analytics website, as well as the current price list provided to business operators.
classic-analytics is liable for intentional or grossly negligent breach of duty in the creation of market observations, as well as the intentional or grossly negligent breach of duty of its legal representatives or vicarious agents.
classic-analytics is not liable for the improper use of its products or services and does not assume liability for damages resulting from technical outages or other technical errors or force majeure. classic-analytics does not guarantee the constant availability of its service. classic-analytics does not assume liability for delays or defects due to unclear, incorrect, or incomplete order transmission or tendering or due to faulty data transfer. Services related to the Update-Service only serve the purpose of providing information and are not grounds for liability.
7. Data back-up
classic-analytics regularly backs up the data stored in customer accounts. If data are lost in spite of this, classic-analytics shall strive to rectify the loss of data as quickly as possible and to return the state before the data loss. This is not an obligation.
9. Amendments to the T&Cs
classic-analytics is entitled to amend these GTC at any time. Customers shall be notified in written form via a letter, fax, or email and the posting of updated GTC to https://classic-analytics.de/en/agb. If the customer does not object or cancel within a time period of two weeks, his or her behaviour is considered consent to the new GTC, which become valid on the date determined by classic-analytics.
10. Final provisions
German law applies. Bochum is the place of jurisdiction for all disputes arising from the legal relationship between the parties. In the event a stipulation of this agreement is or becomes invalid, this does not affect the validity of the remaining provisions. Dated: 13.03.2023
